kWhKey Terms of Service
Effective October 17, 2026
These terms are the agreement between you and Malina LLC ("Malina", "we", "us") for the kWhKey app for Android phones and Wear OS watches, the kWhKey server it talks to, and the website kwhkey.com (together, "kWhKey"). kWhKey is Malina's product.
You accept these terms by tapping the Agree button on kWhKey's consent screen, after ticking the box that says you agree to them. We record which version you accepted and when. If you do not agree, do not use kWhKey.
Please read section 15. It says that disputes are settled by individual arbitration, not in court or as a class action, unless you opt out within 30 days.
1. What kWhKey is
kWhKey is a companion app for Tesla cars. It shows a car's state and history, sends the commands you ask for, runs the features you switch on, and can make your phone or watch a Bluetooth key for the car.
kWhKey is made by Malina LLC. It is not made by, endorsed by, sponsored by or affiliated with Tesla, Inc.
2. Who can use kWhKey
- You must be 18 or older.
- kWhKey is offered in the United States only, and you must live in the United States to subscribe or buy lifetime access.
- You may add a car only if you are its registered owner or lessee, or have their permission.
- A household is the group of phones and watches that share a set of cars. Its owners run it: they connect the cars, invite people, add and remove devices, subscribe, and can delete it. Its members use the cars.
- You are responsible for everyone you let into your household and for everything done from its devices. Everyone in a household can see where its cars are and where they have been, read the activity log, and send commands, unlock included. Invite only people you would hand a car key to.
- Tell the people who drive or ride in your cars that kWhKey records where the cars are and keeps that history, and that your household can see it.
3. Your car account and the services kWhKey relies on
- You connect a car by signing in on Tesla's own sign-in page. kWhKey never sees your Tesla password. By signing in you allow kWhKey to read your Tesla profile and your cars' data, including their location, and to send your cars the commands you or your household ask for, as described in the Privacy Policy.
- kWhKey works only through services that Tesla provides and controls. Tesla can change, limit, suspend or end them at any time, for all apps or for kWhKey alone, and kWhKey may then stop working in whole or in part. We are not responsible for what Tesla does, and sections 4 and 4A say when you get money back.
- Your car, your Tesla account and Tesla's app remain under your own agreements with Tesla. These terms change nothing in them.
- You can end kWhKey's access at any time: remove kWhKey in Tesla's app (Profile > Security & Privacy > Third-Party Apps) and remove kWhKey's key on the car's screen (Controls > Locks).
4. Your subscription
- A subscription or lifetime access is required. kWhKey works for a car only while that car has a kWhKey subscription or lifetime access (section 4A), unless kWhKey shows "Included by kWhKey" for it.
- What you get. One subscription pays for everything kWhKey does for one car, on every phone and watch in your household. The watch app is included. There are no ads, no free trial, no free version and no yearly plan.
- Price. $4.99 per car per month in U.S. dollars, as shown by Google Play before you subscribe. Sales tax, where it applies, is added by Google Play.
- One subscription per car, up to 20 cars. Each car is its own subscription and is cancelled by itself. One household can subscribe for at most 20 cars. Lifetime access counts towards the 20 cars (section 4A). For more cars, write to support@kwhkey.com.
- Billing through Google Play. You subscribe, pay, change and cancel through Google Play, with the payment method on your Google account. Google Play's own terms apply to the payment.
- It renews automatically. Google Play charges you when you subscribe and again every month, at the then-current price, until you cancel. There is no minimum term.
- Cancel any time in Google Play: Payments & subscriptions > Subscriptions > kWhKey (the app's Subscription screen links straight to it). The car keeps working until the end of the month you already paid for, and nothing is charged after that. Deleting the app or your household does not cancel a subscription; the app reminds you before you delete.
- If a payment fails, the car keeps working for at least a week while Google Play tries again. If the payment still fails, the car is locked (section 5) until it is paid for.
- Moving a subscription. An owner can move a car's subscription to another car in the household up to twice in any 30 days. The car it leaves is locked at once.
- Price changes. If we raise the price, Google Play tells you before the higher price is first charged, and you can cancel before then.
- Refunds. Google Play's refund policies apply to your payments, and you can ask Google for a refund under them. In
addition, Malina refunds you through Google Play:
- when you cancel: if you ask us at support@kwhkey.com, the unused days of the month you paid for, worked out for each car separately;
- when kWhKey could not reach your car: in full, the paid month in which kWhKey could not reach that car through Tesla's services for 5 days in a row;
- if Malina ends kWhKey: the unused part of the time you paid for, worked out by days.
4A. Lifetime access
- What it is. Instead of a monthly subscription, an owner can pay once for a car: $199.99 in U.S. dollars, as shown by Google Play before you buy, plus sales tax where it applies. It gives that car everything a subscription gives (section 4, "What you get"), on every phone and watch in your household. It is sold through Google Play only. Lifetime access is a license to use kWhKey for one car under these terms; it does not make you the owner of kWhKey or of any copy of it.
- What "lifetime" means. Lifetime access lasts for as long as kWhKey provides its service for that car. It is not for your lifetime or the car's: it ends if kWhKey stops providing its service for that car, for example because Malina ends kWhKey or because Tesla ends the services kWhKey relies on (section 3).
- If kWhKey stops. For this promise, lifetime access counts as 5 years (60 months) of service from the day Google Play charged you. If, within those 60 months, kWhKey stops serving the car for good for a reason that is not your doing - because Malina ends kWhKey, or because Tesla ends the services kWhKey relies on (section 3) and you do not move the lifetime access to another car - Malina refunds you 1/60 of the price you paid for each month of the 60 that is left, a part month counting as a whole one ($3.33 a month at $199.99). We refund through Google Play, or, where Google Play no longer allows it, in another way we agree with you. After 60 months nothing is refunded when the service ends. If we end your use because you broke these terms (section 12), lifetime access ends without a refund.
- It never renews. Nothing more is charged for that car. There is no renewal, no grace period and nothing to cancel.
- One car, never both. A car has either a subscription or lifetime access. If you buy lifetime access for a car that has a monthly subscription, the monthly subscription is not cancelled by itself: Google Play keeps charging it until you cancel it there. The app shows you the link to cancel it before and after you buy. Once lifetime access is active on the car, the subscription no longer pays for that car; you can cancel it, or put it on another car. If you cancel it, you can ask us for the unused days of its month (section 4).
- Moving it. An owner can move lifetime access to another car in the household under the same rule as a subscription: up to twice in any 30 days. The car it leaves is locked at once (section 5).
- It counts towards the 20 cars. Subscriptions and lifetime access together pay for at most 20 cars in one household.
- Refunds. Google Play's refund policies apply, including its own refund window, and you can ask Google for a refund under them. In addition, Malina refunds a lifetime purchase in full, for any reason, if you ask at support@kwhkey.com within 14 days of the day Google Play charged you for it.
- When kWhKey could not reach your car. The refund in section 4 for a month in which kWhKey could not reach the car through Tesla's services for 5 days in a row applies to lifetime access too, within the 60 months that "If kWhKey stops" counts, at 1/60 of the price you paid for each such month ($3.33 at $199.99). After those 60 months it no longer applies, so refunds never add up to more than you paid. For this, a lifetime month runs from the day of the month on which Google Play charged you. A month refunded this way is not refunded again under "If kWhKey stops".
- A refund or chargeback ends it. When a lifetime purchase is refunded, charged back or cancelled by Google, the car's lifetime access ends and the car is locked (section 5) until it is paid for again.
5. When a car is not paid for
- A car without a subscription or lifetime access is locked: it loses every kWhKey function on every phone and watch in your household, kWhKey's Bluetooth key included. The app shows the car's name, its picture, its model, its year and the last digits of its VIN, "Location not recorded" and a way to subscribe, and nothing else of it.
- Your Tesla key card, key fob and Tesla's app are not kWhKey's and keep working as always.
- A paid car's key never expires on your phone or watch by time, however long the device is offline. A car locks on a device when kWhKey's server tells that device, which happens the next time the device is connected to the internet. A phone or watch that has been offline since the car's subscription or lifetime access ended therefore keeps working as a key for that car until it next connects. Do not keep a device offline to go on using kWhKey for a car that is no longer paid for.
- While a car is locked, kWhKey stops asking Tesla about it and, 24 hours after the lock, asks Tesla to stop the car's live data. Nothing already recorded is deleted: subscribe again and the car's history and features come back.
6. Safety
kWhKey acts on a real car. Using it safely is your responsibility.
- Features that act on their own are off until you switch them on. Routines, Sentry by place, turning cabin overheat protection back on, and its hot-day part each start off for a new household and each has its own off switch. When you switch one on, it is your own instruction: it does what you set it to do when the car's data says so, also when you are not looking. You are responsible for the features you switch on.
- Remote commands. A command (unlock, trunk or front trunk, windows, climate, charging, horn, lights, garage door and others) is carried out even when you cannot see the car. Before you send one, make sure it is safe for the people, animals and things at the car. You are responsible for every command sent from your household's devices.
- The Bluetooth key. A phone or watch that is a Bluetooth key can unlock the car and let whoever holds it drive. Treat it like the car's key. You decide who has one. A key you no longer want must be removed on the car's own screen (Controls > Locks); kWhKey cannot take a key off a car.
- Never while driving. Do not use kWhKey, on a phone or a watch, while you are driving.
- Not an alarm, not a safety system, not for emergencies. A notice from kWhKey can come late or not at all. Do not rely on kWhKey to protect a car, a person or an animal, and do not use it in an emergency.
- What kWhKey shows can be old or wrong. Range, charge, tire pressures, costs, battery health, reminders and trip logs come from what the car reported. The car and its own screen come first. The mileage report is not tax advice.
7. Acceptable use
You agree not to:
- use kWhKey to follow, watch, stalk or harass anyone, or to find out where a person is without their knowledge;
- add a car you are not allowed to add (section 2), or reach another household's cars or data;
- get around the subscription or the lock, including by keeping a device offline on purpose (section 5);
- copy, resell or rent kWhKey, or reverse engineer it except where the law allows;
- disturb, overload or probe the service, or get around its security;
- break the law, including the rules on using a phone in a car.
Keep your phones and watches locked, and remove a lost or stolen device from your household at once.
8. What you put into kWhKey
The names, places, routines, records and photos you add remain yours. You allow Malina to store them, to process them to run kWhKey for you, to show them to your household, and to show the friends you add your household's name and, for each car you show them, the car's name, model, year and look (paint and wheels), its picture, the pattern on its card and the items you switch on for them. This permission ends when you delete them or your household, apart from the copies described in the Privacy Policy.
9. Your data and your cars' location
kWhKey cannot work without knowing where your cars are. With your consent it records each car's position, keeps the history, shows it to your household and uses it for trips, places, charging costs and the features you switch on. What kWhKey collects, who receives it, how long it is kept and how to delete it are in the Privacy Policy at kwhkey.com/privacy, which is part of what you agree to.
10. No warranty
To the extent the law allows, kWhKey is provided "as is" and "as available", and Malina gives no warranty of any kind, express or implied, including that kWhKey will work without interruption or error, that a command will reach the car, that a notice will arrive, or that what it shows is right. Some states do not allow these exclusions, so some may not apply to you.
11. Limits of liability
To the extent the law allows:
- Malina is not liable for indirect, incidental, special or consequential loss, or for lost profits or data, arising from kWhKey, including from a command that was sent, not sent or late, from a feature you switched on, or from a key in someone's hands.
- Malina's total liability to you for all claims about kWhKey is limited to the greater of what you paid for kWhKey in the 12 months before the claim and US$100.
- These limits do not reduce a refund that section 4 or 4A promises.
These limits do not apply to death or personal injury caused by Malina's negligence, to Malina's gross negligence, wilful misconduct or fraud, or to anything else the law does not allow to be limited, and they do not take away rights you have under consumer protection laws that cannot be waived.
12. Ending
- You can stop at any time: cancel your subscriptions in Google Play and delete your household or device in the app (Menu > Delete my data). Lifetime access needs nothing cancelled. Deleting your household does not refund it; restore it in a new household with the same Google account.
- We may suspend or end your use of kWhKey if you break these terms, if your use puts people or the service at risk, if Tesla ends or limits kWhKey's access, or if we stop offering kWhKey. Where we can, we tell you first. If we end kWhKey for a reason that is not your fault, section 4 (subscriptions) and section 4A (lifetime access) say what we refund.
- Your car, its keys and Tesla's app are not affected when your use of kWhKey ends; see the Privacy Policy for how to finish at the car.
- Sections 8 (as to copies), 10, 11, 15 and 17 continue after these terms end.
13. Changes
kWhKey changes over time: features are added, changed and removed, and the app needs its updates to keep working. When these terms change, we post the new version at kwhkey.com/terms with a new date. If a change is material, we tell you in the app before it takes effect and ask you to accept it; if you do not, you can cancel and delete your household. A change never applies to a dispute that arose before it was posted.
14. Google Play
You get kWhKey from Google Play, and Google Play's own terms apply to your download and your payments. Google is not a party to these terms and has no duty to support kWhKey; Malina alone is responsible for kWhKey and its support. If these terms conflict with the Google Play terms that apply between you and Malina, Google's terms prevail.
15. Disputes and arbitration
- Talk to us first. Before starting arbitration or a court case, the side with a claim sends the other a written description of it and what it wants (to us: support@kwhkey.com; to you: in the app, or at the email address you wrote to us from). Both sides then try for 30 days to resolve it. Time limits for the claim are paused during those 30 days.
- Small claims. Either side may take an individual claim to small claims court instead, if it qualifies.
- Individual arbitration. Otherwise, any dispute between you and Malina about kWhKey or these terms is settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and, for 25 or more similar claims coordinated by the same lawyers, its Mass Arbitration Supplementary Rules (adr.org). The Federal Arbitration Act governs this section. The arbitrator can award the same individual relief a court could, including an injunction for you alone. The hearing takes place in the county where you live or by video or phone, as you prefer.
- Fees. Malina pays all AAA filing, administration and arbitrator fees beyond the filing fee the AAA's consumer fee schedule asks of you, and Malina never seeks its own lawyers' fees from you unless a court could award them.
- No class actions. You and Malina each bring claims only individually, not as a plaintiff or class member in any class, collective or representative action.
- Public injunctions. A claim for an injunction that would benefit the general public goes to a court, after the individual claims in arbitration are decided; the court case waits until then.
- If part of this fails. If the class-action waiver is found unenforceable for a claim, that claim goes to court, not to class arbitration. If any other part of this section is unenforceable, the rest still applies.
- Opting out. You can opt out of this section by emailing support@kwhkey.com within 30 days of first accepting these terms, with your name, your household's name and the words "I opt out of arbitration". Opting out does not affect anything else in these terms.
- Courts and law. These terms are governed by the laws of the State of California, apart from its conflict-of-laws rules; the Federal Arbitration Act governs section 15. Anything not arbitrated goes to the state courts in Los Angeles County or the federal court for the Central District of California, unless you take it to small claims court where you live. Nothing here takes away protections the law of the state you live in gives you and does not allow you to waive.
16. Reviews
You are free to write honest reviews of kWhKey, good or bad. Nothing in these terms limits that.
17. General
- These terms, the Privacy Policy and what you accept on the consent and purchase screens are the whole agreement between you and Malina about kWhKey.
- If a part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a right, we have not given it up.
- You may not transfer these terms to someone else. Malina may transfer them to whoever takes over kWhKey, and we will tell you if it does.
- We send you notices in the app, or by email if you have written to us; you send yours to support@kwhkey.com.
- Malina is not responsible for delays or failures caused by things beyond its reasonable control, including outages at Tesla, Google or our hosting providers.
